The ContraCostaTimes.com has a guest commentary by Mike Postich
The only document he has made available is a Hawaiian Certification of Live Birth. This abbreviated form does not indicate the hospital where Obama was born, nor does it include the name of the attending physician or midwife. There is no official signature of any kind verifying its accuracy.
And yet, the document does not only have the raised seal but photographs reveal that the document is signed as well. Furthermore, the Department of Health in Hawaii has confirmed that Obama was born in Honolulu.
The form also has a revision date of November 2001 and is computer generated, which clearly demonstrates that it is not the original document of his birth.
What part of certification of live birth, which is prima facie evidence does Mike not understand?
Why is Mike refusing to acknowledge that the COLB is the official and only Birth Certificate of the State of Hawaii and that the document shows Obama born in Honolulu?

Polarik seems to misinterpret the following statement:

“Absolutely not. No one in our office confirmed it.”
and claims
But, the real killer of this birth certificate scam is that Hawaii never made a 2007 Certification of Live Birth for Obama, never issued a 2007 COLB for Obama, and never confirmed anything about this bogus 2007 COLB that Obama, his staff, and Factcheck have insisted is a real document.
While this may be very well true, since Hawaiian law prohibits disclosure of such information, there is no reason to conclude that Hawaii never issued Obama’s 2007 COLB.
That should settle it.

Dr Conspiracy reports how the Department of Health officials in Hawaii continue to emphasize not only that the COLB is the official Hawaiian Birth Certificate but also that it shows that Obama was born in Honolulu, and not foreign born:
As for the theory that Obama’s original birth certificate might show he was foreign born, Okubo said the “Certification of Live Birth” would say so. Obama’s does not. Again, it says he was born in Honolulu.

What do we know?
According to President Obama’s Certification of Live Birth, he was born on August 4, 1961 in Honolulu Hawaii. The document was filed 4 days after his birth, on August 8th.
Several people have pointed to various Hawaiian laws to generate doubt about the event.
Let’s look at the facts.
First there is the claim that HRS338-17.8 allows children born out of state of residents who claimed Hawaii as their legal residence at least one year prior to birth to be registered in Hawaii.
[§338-17.8] Certificates for children born out of State. (a) Upon application of an adult or the legal parents of a minor child, the director of health shall issue a birth certificate for such adult or minor, provided that proof has been submitted to the director of health that the legal parents of such individual while living without the Territory or State of Hawaii had declared the Territory or State of Hawaii as their legal residence for at least one year immediately preceding the birth or adoption of such child.
(b) Proof of legal residency shall be submitted to the director of health in any manner that the director shall deem appropriate. The director of health may also adopt any rules pursuant to chapter 91 that he or she may deem necessary or proper to prevent fraudulent applications for birth certificates and to require any further information or proof of events necessary for completion of a birth certificate.
(c) The fee for each application for registration shall be established by rule adopted pursuant to chapter 91. [L 1982, c 182, §1]
The first problem is that this law was passed in 1982 (this is what [L 1982, c 182, §1] refers to), 21 years after Obama’s birth. The second problem is that Obama’s birth certificate was filed with 4 days of his birth. Finally, the city of birth on the birth certificate is “Honolulu, Hawaii”. In other words, it is unlikely that the COLB which is now the official Hawaiian birth certificate was filed under 338-17.8. In fact, late filings also HRS 338.16 which states that late filings will be marked distinctly as “late” and the filing date reflects the late filing.
§338-16 Procedure concerning late and altered birth certificates. (a) Birth certificates registered one year or more after the date of birth, and certificates which have been altered after being filed with the department of health, shall contain the date of the late filing and the date of the alteration and be marked distinctly “late” or “altered”.
(b) A summary statement of the evidence submitted in support of the acceptance for late filing or the alteration shall be endorsed on the certificates.
(c) Such evidence shall be kept in a special permanent file.
(d) When an applicant does not submit the minimum documentation required by the rules for late registration or when the state registrar finds reasons to question the validity or adequacy of the certificate or the documentary evidence, the state registrar shall not register the late certificate and shall advise the applicant of the reason for this action.
The department of health may by rule provide for the dismissal of an application which is not actively prosecuted.

Question: What is the state’s policy for issuing a “Certification of Live Birth” versus a “Certificate of Live Birth”? My first, second and fourth children received certificates, but my third and fifth children received certifications. Why the difference? The certificate contains more information, such as the name of hospital, certifier’s name and title; attendant’s name and title, etc. The certification has only the child’s name, date and time of birth, sex, city/island/county of birth, mother’s maiden name, mother’s race, father’s name and father’s race. Why doesn’t the state just issue certificates? When did it stop issuing certificates? Is it possible to obtain certificates for my third and fifth children?
Answer: No, you can’t obtain a “certificate of live birth” anymore.
The state Department of Health no longer issues copies of paper birth certificates as was done in the past, said spokeswoman Janice Okubo.
The department only issues “certifications” of live births, and that is the “official birth certificate” issued by the state of Hawaii, she said.

In devasting developments to the Birther movement, the Hawaiian State Department of Health spokesperson Janice Okubo has announced that that “the “Certification of Live Birth” is now the official birth certificate of Hawaii. Long forms are no longer available”.
Hawaii has been on the forefront of converting its antiquated system to an electronic system.
The department only issues “certifications” of live births, and that is the “official birth certificate” issued by the state of Hawaii, she said.

Comment: Begging the question. In fact, as several early court cases and common law history have shown, the fact that one or more parents has some allegiance to another country, does not mean that a child born on US soil has the same allegiance. In fact, under allegiance of, is a term commonly misconstrued when all it means is that the child has to obey the laws of the country. This was added to exclude children from diplomats, who are born under diplomatic immunity, and children of invading military.

Comment: A fascinating collection of previously shown flawed claims, arguments and assertions. Not surprisingly they have still made it in the next filing of Orly. My prediction: As with Holder, the DOJ will ignore her and Orly will call for the resignation of yet another Federal Officer. This is a work in progress in which I intend to address all the claims made. As others, who are much more informed that I, have pointed out, Orly has filed a court case in DC without proper local representation. That’s going to be interesting to see. In addition, the document contains several spelling errors such as Vatall and errors of fact such as “fn. 192 Hollister v. Soetoro, 2d Cir. D.C. Cir. No. 1:08-cv-02254-JR, Motion to Dismiss Jan 26, 2009.” Contrary to the citation “Hollister was neither in the Second Circuit nor the District of Columbia Circuit”, it was in the US District Court for the District of Columbia. At the Huffington Post, Terry Krepel writes on the ‘controversy’ created by WorldNetDaily noting how in 2008, WorldNetDaily’s own investigation had debunked the conspiracy around Obama’s Certification of Live Birth:

Comment: Has noone informed Orly that the Keyes v Bowen lawsuit has been thrown out? The FOIA action, which was just recently touted by Orly as “US Attorney Generals signing on to her cause”, but was in fact nothing more than a refusal of the DOJ to abide by the issued Subpoena, seems to be moot right now. What is interesting is how many of the disproven assertions Orly still seems to be considering ‘facts’. Enjoy. My predictions? The FOIA request will be thrown out as moot.

COLB – Comparing two 2007 versions March 16, 2009

Ron Polarik has a second 2007 COLB which was obtained less than 3 months before Obama obtained his. I have compared the two COLB’s by carefully overlaying one over the other and not only do the borders lign up, but also the text. Both COLB’s have the same City and Island of Birth (Honolulu, Oahu).
Combined with the previous analysis which shows the presence of folds, the raised seal and the signature stamp, it seems hard to argue that Obama’s COLB was somehow a fake.

Now, both overlaid (click to enlarge). I had some difficulties to align the two since the scan of the 2007 COLB was slightly skewed. I aligned the sides of the borders. Note how the City and Island of Birth overlap nicely.

Orly Update
Orly Taitz reports that she managed to get Robert’s attention and delivered a box full of documents to his security people. While I have to admire the tenacity of Orly, her posting also reveals an aspect which I personally find troublesome. And no it is not the lack of legal support for her claims, and it is not the speculative nature of her assertions, no it is the following statement
Why are you afraid to speak up, to stand up for you constitution? Why are you afraid to tell this arrogant jerk from Africa and Indonesia- You need to go home, you cannot be a president and commander in chief because you are not a Natural born Citizen. To be a Natural born Citizen you have to have both parents as citizens. Your father was never a US citizen and you don’t qualify and you also spit us in the face by refusing to unseal your vital records. There is no proof that you are even a citizen. For all we know, you need to go back to Kenya and wait for your green card, and that after we try you for all the crimes perpetrated upon American citizens.
As I and others have already pointed out, there is no credible evidence that President Obama is an Usurper. In fact, since he is the de facto and likely also the de jure President of the United States, we cannot make claims that lack in supporting evidence.

Updated 2009-03-12: Added Error Level Analysis graphs for Obama’s COLB and a faked version to show what a true faked version looks like.
Given some of the conflicting stories surrounding Obama’s Certification of Live Birth (COLB), I decided to collect the many relevant images, include the highest resolution jpg and do some of my analysis. I will be adding the relevant pictures over time, so check back regularly. Note that I am not claiming to have any expertise in image analysis beyond my ability to read relevant papers, and use third party software. However, this is not rocket science either and anyone interested in the ‘controversy’ could have done the necessary work. But rather than focusing on the data which confirm that the COLB is a valid certificate, some seem to have been more interested in finding minor ‘discrepancies’ which can be easily explained when one understands JPG compression as well as scanning artifacts and the procedures of the Hawaiian DOH.
I have come to the conclusion that the original document shows

Guess what, in order to work for the Pearl Harbor shipyard you need one of the following documents. In other words, the Certificate of live birth is different from the delayed birth certificate or the certificate of foreign birth. Now we already know that Obama’s certification of live birth could not have been based on a certificate of delayed birth since the registration date is a few days after his birth. We also know that his certification of live birth could not have been a certificate of foreign birth since the city of birth is “Honolulu”

Same old assertions, many of which are simply incorrect such as the claim that since Obama’s father was not a US Citizen, Obama could not possibly have been a natural born citizen even though the courts have ruled that children of aliens born in the US gain US citizenship by birth right.
Some other goodies:
Selective Services: Failed to register under his legal name Barry Soetoro. Thus the Selective Services registration signed by Barack Obama must be fraudulent.
There is nothing ‘this man’ (Obama) says which is ever true.
It comes to the point of treason.
And then the conspiracy again: “An interesting fact is that both Michelle and Barack Obama have job description positions listed with all major news agencies and news papers.”

A quick reality check, before we dive in: The challenges to Obama’s eligibility have no grounding in evidence. Courts across the country have summarily rejected the movement’s theory — that Obama can’t be a citizen because his father wasn’t —as a misreading of U.S. law; and Hawaii officials, along with contemporary birth announcements, affirm that Obama was in fact born in Honolulu in 1961.
Pointing out my observation that the actions by nObama’s may serve to undermine Obama’s more mainstream opponents
The opportunity for the White House? It’s one of which some conservatives are sharply aware — that the Birthers may discredit Obama’s more mainstream enemies.

My daughter was born in Hawaii in 1965, I sent a request for her long form BC as we were originally give a the same form as Obama received. Here is their email response. (I previously received similar verbal response)
