  1. If this is the complaint against NSA et. al, I think SCOTUS only denied it to allow the U.S. Court of Appeals for DC to hear the case. IMO, next time around, the Supremes will grant certiorari.

  2. Perhaps. Hard to tell with Scotus. I am not sure why Klayman tried to jump the gun here.
