Honestly?… How long did it take these geniuses to figure out that which courts have already ruled? Rondeau, Orly, Fitzpatrick are all clueless…

The foreman of the jury is appointed and thus not the same as a juror, however together with the jurors, they form the Grand Jury.

Good luck on arguing that this is a deprivation of rights since the courts have approvingly observed how TN is somewhat different.

Such incompetency… We have been citing the relevant rulings and statutes for years and they still do not get it…

And Fitzpatrick continues to led his ‘beliefs’ get him arrested and jailed…

Rule 6 of the TN Rules of Criminal Procedure:

The foreperson and the twelve qualified jurors whose names are first drawn constitute the grand jury for the term and shall attend the court until dismissed by the judge or until the next term.

The foreperson and the twelve jurors whose names are first drawn… Clearly explaining that the foreperson is NOT obtained necessarily from the same pool, nor that his/her name is drawn.

So who selects the foreperson?

Rule 6(g)

g) Appointment, Qualifications, Term, Compensation, Vote, and Duties of Foreperson.

(1) Appointment of Foreperson. The judge of the court authorized by law to charge–and receive the report of–the grand jury shall appoint the grand jury foreperson. When concurrent grand juries are impaneled, the court shall appoint a foreperson for each grand jury.

In 1983 the Tennessee Court of Appeals ruled there is no language in Tennessee Criminal Court Rules of Procedure stating a grand jury foreperson is limited in how many terms they can serve.

So we have the US Supreme Court observing

Moreover, Rose must be read in light of the method used in Tennessee to select a grand jury and its foreman. Under that system, 12 members of the grand jury were selected at random by the jury commissioners from a list of qualified potential jurors. The foreman, however, was separately appointed by a judge from the general eligible population at large. The foreman then served as “`the thirteenth member of each grand jury organized during his term of office, having equal power and authority in all matters coming before the grand jury with the other members thereof.'” Rose [468 U.S. 339, 348] v. Mitchell, supra, at 548, n. 2 (quoting Tenn. Code Ann. 40-1506 (Supp. 1978)).

Given the fact that any foreman was not limited in the number of 2-year terms he could serve, and given the inclination on the part of the judge to reappoint, it is likely that during the period in question only a few persons in actual number served as foremen of the grand jury.

These bills typically die in committee. I am disappointed in the ‘investigative’ abilities of those involved.

    Because they don’t want to investigate, they want to remain in their closed belief system that the the judicial system is somehow “corrupted”. This confirmation bias then governs the way they read, understand and ignore as they see fit.

  3. I must admit, I was surprised as this developed. At one time, Sharon was getting her birther material from several sources. When Walt came on the scene, I assumed that her interest in him as a birther would wane as she came to discover how totally deranged he was.

    Instead, she became completely enamored of him and has let the P&E become the primary outlet for his wingnuttery.

  4. If anyone ever wants a clue as to just how incompetent a lawyer Orly is, this is a big one. The only “shocking” thing about this is that she finally got around to noticing it. As I recall, it’s been several years since this was all discussed in detail here, at Doc Conspiracy’s, and at the Fogbow. Since Orly does look at at least one or more of them, you’d think this might have registered with her.🙄
