AL – McInish v Chapman – Reply plaintiff [Updated]

The Fogbow reports (HT: Obamalaw)

Klayman has filed a Second Motion to Strike the ADP’s response to his initial motion to strike. It is hilarious. It argues that the ADP’s filing is “scandalous” for attacking Zollo’s qualifications and “unbecoming” of the President, while simultaneously referencing the IRS and Benghazi.

Yes, the court will be impressed by these irrelevant references while taking notice of the description by the defendants of Zullo who signed the affidavit as a private person.

Poor Klayman, again he appears to have fallen for the trap set…

Document will be uploaded once the Fogbow reports on it.

SCOAL 2013-05-24 McInnish|Goode v Chapman – Appellants’ Second Motion to Strike

Oh boy did Klayman take the bait and bite. And he still does not explain why, if Zullo signed as a private citizen, instead trying to ‘argue’ that Zullo holds any law enforcement position… In the end it does not matter as the ADP has clearly outlined what the issue to be decided is, and it is not about the eligibility of our President…

  1. “Poor Klayman, again he appears to have fallen for the trap set…”

Exactly. The ADP’s amicus brief and it’s associated reply to the motion to strike was brilliantly crafted to expose the Plaintiffs as absolute idiots. Klayman took the bait, hook, line and sinker. Expect a terse and drama free dismissal.

  2. It’s great the Klayman responded. Barry Ragsdale really lives up to his name. He really knows how to write a rag. The ADP’s position seem to indicate that they want to void the authority of county sheriff and prevent a county sheriff from upholding his sworn oath to serve the citizens he or she has jurisdiction over. Zullo’s affidavits speaks the facts. The citizens of Maricopa County petitioned their sheriff to do his duty and Arpaio upheld his oath. It would also be a further advantage to point out that the CCP does not exist exclusively because of the Obama birth certificate issue but has existed for a number of years. Citing some past work from the CCP would be most helpful and again bolster the argument that Arpaio and CCP are “official sources”. I also see the Lucas Smith submitted an amicis brief with the Kenyan birth certificate of Obama he apparently obtained in Kenya. Klayman should respond to it. His amicis brief again strengthens the CCP investigation. In addition, it should be noted that Lucas Smith was prepared to testify in the Judge David Carter case with Orly Taitz out in California. Lucas Smith was to testify under oath how he obtained the Kenyan Birth certificate. Further, Judge Carter even insisted the defense should allow him to testify. The defense refused to yield and Lucas Smith didn’t testify. The case was later dismissed and Lucas Smith was never given another chance.

  3. I see the US Justice Foundation filed an Amicis Brief. I think Van Irion of his Legal Foundation should file one as well.

  4. I’ve been following the character, John, for sometimes in various blogs. There is just no way he and/or she can a grown up individual.

  5. John, what you don’t fully appreciate is that the ADP has effectively exposed the Plaintiff’s case as the nonsense factory it is. And, for the record, Sheriff Arpaio hasn’t invested his “authority” in this case. Zullo submitted his affidavit as a private individual.

The ADP amicus brief and reply to the Motion to Strike has been an effective rope-a-dope of Klayman. Klayman’s juvenile responses have guaranteed a terse and expeditious dismissal of his appeal.

  6. The ADP’s position seem to indicate that they want to void the authority of county sheriff and prevent a county sheriff from upholding his sworn oath to serve the citizens he or she has jurisdiction over.

ROTFL… The musings of private citizen who worked under Arpaio as a volunteer ‘posse’ have no relevance or value to this case.

Also Lucas Smith has no chance to be heard here either. You still do not understand our legal system now do you?

  7. Yes he USJF ‘Amicus’ brief is hilarious as it cites a case which supports the SOS🙂

John appears to hate our president and this hate prevents him from rationality. Just my thought.

Exactly. Why have people not asked Zullo why he signed as a private citizen and why Arpaio not signed off…

  10. Even Orly understands…

I agree with everyone who commented here previously. There is nothing Arpaio and Zullo can do in front of the Supreme Court of AL. The supreme court of AL does not allow any witness testimony or any new evidence. The only thing Arpaio can do and has to do, is file a criminal complaint in Maricopa county AZ, where he is a Sheriff. He could have done it a year ago. For a year he has been talking and promising, but did not do his job as a sheriff. It is noteworthy that when Arpaio could testify in trial court in CA, GA, MS, when I subpoenaed him to testify, he refused to do so. Now, when testimony is forbidden by the rules of the Supreme Court he says he will help. This is just noise for fundraising purpose, no real action. Everyone should tell Carl Gallops-PPSimmons, Zullo and Arpaio to stop talking and file the criminal complaint immediately or refund the donors who were mislead and believed that Arpaio will file a criminal complaint before the election

    Cheers, John

we went from an AZ sheriff and his flock of frozen fools with ALL of the SUPPOSED authority in the world to a private AZ citizen submitting an affidavit in AL?

SERIOUSLY???????? an affidavit from MOI has as much importance ….. oh and i need money so please donate

  12. John: The ADP’s position seem to indicate that they want to void the authority of county sheriff and prevent a county sheriff from upholding his sworn oath to serve the citizens he or she has jurisdiction over.

    John, once more:

    1. Maricopa is not in Alabama. No Jurisdiction.

    2. Zullo’s affidavit provides no authority. He signs it as an individual and gives no evidence that he has any law enforcement certification (and thus, authority), in the state of Arizona (or Alabama). No Authority.

    3. The Sheriff never provided an affidavit to the court that states that Zullo is investigating under the authority of the Maricopa County Sheriff’s Office. No Support.

    4. Zullo claims to be running an investigation on donations. Buying a criminal investigation? No Bueno.

    John… No Clue.
