Educating the Confused – Orly and court reporters

December 12, 2012

Appeal of decisions of CA judge Charles Marginis (sic) is now in front of the court of Appeals. I could swear that I saw a court reporter during October 29 and November 1 hearings. Clerk is telling me that there is no transcript because there was no court reporter and they do not provide audio tapes. I need people, who were there to let me know, if they recall seeing the court reporter at October 29 and November 1 hearings. This is just insane

It’s Judge Margines….

The OC Superior Court explains

The proceedings for which official court reporters shall normally be provided will be posted in the clerk’s office at each justice center. Below you will find Notices of Availability of Court Reporting Services, the Family Law Non-Court Reporter Calendar, and Request for Court Reporter Form.

The minute order on Orly own site outlines (NBC: Orly showed an earlier minute order), can she not do her own research? There was no court reporter present.

It seems she could have requested a court reporter by filling out a form. But Orly Taitz is too important to deal with such minor details.

Not sure if that applies. The court room was supposed to have court reporter services but it is unclear to me if she should have requested it. An earlier hearing did have a reporter.

It was just an ex parte hearing for goodness sakes. The court reporters have better things to do than trying to translate Orly…

The entries above also tell her there was no electronic recording (ERM).

It is not unusual that court reporters/recording is not done at motions hearings. I’ve not seen the sheet which explains when (normally) reporters/recordings would be available, but all one has to do is read it and if it indicates this is not an instance where there automatically would be a reporter or recording made, request it and they’ll be there.

I’m no legal genius but having worked for 40 years in the system I do know a little something about court reporting and reporters. It has changed somewhat over the years, especially with budget cuts, but it’s just not that difficult to figure this stuff out… unless one is dumber than rock, as Orly continues to demonstrate she is.

I am still looking for the rules for recording/reporting of ex-parte hearings.
